Subject: Final Integrated Seniority Lists

As you know, I have been asked by the IAM and ExpressJet to oversee the seniority integration review process for the combination of seniority lists resulting from the merger of Atlantic Southeast Airlines (“ASA”) and ExpressJet. I am pleased to report that this review process is completed and that an integrated seniority list for IAM-represented Flight Attendants has been finalized and will be published in conjunction with this Memorandum.  This list is the culmination of a comprehensive process governed by federal law and the parties’ agreement.

On March 19, 2019, the IAM published the initial integrated seniority list along with my cover letter explaining the protest process. Affected members represented by the IAM were given until May 15, 2019 to file written protests with my office concerning their placement on the integrated seniority list. A total of 57 protests were filed by the deadline.  In order to resolve these protests, necessary records were obtained from the Company and the IAM.  Each protestor will separately receive an individual determination letter regarding his or her protest. Now that the protest process has concluded, I can report that no changes were made to the original proposed list.  As noted in my March 19, 2019 Memorandum, however, by agreement of the parties, the integrated list will not go into effect until a final joint collective bargaining agreement is in place.

I want to thank employees for their active participation in this process through their comments and protests which helped ensure the accuracy of the integrated lists. I also wish to thank the IAM, ExpressJet, and the law firm retained to assist me in this process, Guerrieri, Bartos & Roma, for their hard work and cooperation in this process of achieving an integration of seniority that is fair and equitable to all employees affected by this merger.
